The rules of the road for nyuSpace.

By accessing or using nyuspace.com (the “Platform”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Platform. We may update these Terms at any time; continued use after changes means you accept the updated Terms.

You must be at least 18 years old and able to enter into binding contracts to use nyuSpace. By creating an account, you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for safeguarding your account credentials and for any activity under your account. Notify us immediately at hello@nyuspace.co.ke if you suspect unauthorised use. We may suspend or terminate accounts found to be fraudulent, impersonating others, or otherwise in breach of these Terms.

When using nyuSpace, you agree not to:

• Post false, misleading, duplicated, or unlawful listings.
• Harass, defraud, or harm other users.
• Scrape, reverse-engineer, or interfere with the Platform.
• Use the Platform to send spam, malware, or unsolicited marketing.
• Circumvent verification, payment, or security mechanisms.

Agents and sellers (“Listers”) are solely responsible for the accuracy, legality, and rights to publish each listing. By posting a listing, you grant nyuSpace a non-exclusive, royalty-free licence to host, display, and promote the listing on the Platform and in our marketing channels.

We may edit, decline, or remove any listing that violates these Terms, our content guidelines, or applicable law. Featured placement and visibility boosts are discretionary and may be revoked for policy violations.

nyuSpace performs reasonable verification of agents and listings, including document checks and content moderation. Verification reduces risk but does not guarantee the conduct of any user, the condition of any property, or the outcome of any transaction. Always conduct your own due diligence before viewing, paying for, or transacting on any property.

Paid plans — including Flat Fee, Bundle, Unlimited, and Featured Listings — are processed via Paystack. By purchasing, you authorise the listed amount to be charged to your selected payment method. Subscriptions renew on the cycle stated at checkout until cancelled. Prices are listed in Kenyan Shillings (KSh) and are inclusive of applicable taxes unless stated otherwise.

Listing purchases and subscriptions are generally non-refundable once activated. We may issue a refund at our discretion if the Platform fails to deliver the paid service due to a fault on our side. Refund requests must be sent to hello@nyuspace.co.ke within 14 days of payment.

The Platform — including its design, code, logos, and content (excluding listing content owned by Listers) — is the intellectual property of nyuSpace. You may not copy, modify, distribute, or create derivative works without prior written permission.

The Platform integrates with third-party services such as Google sign-in, Paystack, WhatsApp Business API, Mapbox, and Africa's Talking. Your use of those services is governed by their respective terms. nyuSpace is not responsible for their availability or behaviour.

The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, nyuSpace disclaims all warranties — express or implied — including fitness for a particular purpose, accuracy of listings, and uninterrupted availability. nyuSpace is a marketplace; we are not a party to property transactions between users.

To the fullest extent permitted by law, nyuSpace, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, goodwill, data, or other intangible losses, arising from or in connection with your use of the Platform. Our total liability for any claim shall not exceed the greater of (a) the fees you paid to nyuSpace in the 12 months preceding the claim, or (b) KSh 10,000.

You agree to indemnify and hold nyuSpace harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Platform, your listings, your conduct, or your breach of these Terms.

You may stop using the Platform at any time. We may suspend or terminate your account, with or without notice, if you violate these Terms or applicable law, or if continued provision becomes commercially or legally untenable. Sections covering Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

These Terms are governed by the laws of the Republic of Kenya. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.

We may update these Terms from time to time. Material changes will be communicated via email or a Platform banner. Your continued use after changes take effect constitutes acceptance.
